These Terms of Service ("Terms") govern your use of sickwebsites.com (the "Site") and your purchase of website design services ("Services") from Sick Websites, a service operated by G! Marketing LLC ("we," "us," or "our").

By placing an order or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase Services.

1. Services Described

Sick Websites provides done-for-you website design and development services for service businesses. Our service packages include:

• Landing Page ($495): A single high-converting page with SEO-driven copy, mobile-responsive design, contact form, and CTA setup. Delivered in approximately 3 business days.
• 3-Page Website ($1,350): Home page plus 2 additional pages with SEO copy, responsive design, contact forms, and analytics. Delivered in approximately 7 business days.
• 5-Page Full Site ($2,695): Home page plus 4 additional pages with deep SEO, conversion tracking, CTA funnels, and schema markup. Delivered in approximately 10 business days.

Optional add-ons include stock content sourcing and website hosting. Delivery timelines are estimates and may vary based on project complexity, client responsiveness, and revision requests.

2. Orders and Payment

When you place an order through the Site:

• You agree to provide accurate and complete information in the intake form.
• Payment is due at the time of order. All payments are processed securely through Stripe, Inc.
• Prices are listed in US Dollars (USD).
• By completing a purchase, you authorize us to charge the payment method you provide through Stripe for the total amount shown at checkout.
• You will receive an email confirmation after payment is processed.

3. Refund and Cancellation Policy

We stand behind our work with a 100% money-back guarantee. Here is how our process and refund policy works:

• Homepage design review: After you place an order, we will send you a homepage design for your approval. This is your first look at the direction of your site.
• If you love it: We proceed to build out the remaining pages and launch your full site.
• If you want changes: You receive up to 2 rounds of design revisions on the homepage at no additional cost.
• 100% money-back guarantee: If after 2 rounds of design revisions you are still not satisfied with the homepage design, we will issue a full refund of your payment. No questions asked.
• After design approval: Once you approve the homepage design and we begin building out the full site, refunds are no longer available. We will continue to work with you through the build to ensure satisfaction.
• Hosting subscriptions: Monthly hosting can be cancelled at any time. Annual hosting is non-refundable after the first 14 days.

4. Client Responsibilities

To deliver your website on time, we need your cooperation. You agree to:

• Provide accurate business information, branding assets, and content as requested
• Respond to project communications (emails, texts) within a reasonable timeframe
• Review deliverables and provide revision feedback promptly
• Ensure you have the right to use any content, images, logos, or trademarks you provide to us

Delays caused by late or missing client input may extend the delivery timeline beyond the estimated window.

5. Intellectual Property

Your Content

You retain full ownership of all content, logos, images, and branding materials you provide to us. By submitting content, you grant us a limited, non-exclusive license to use it solely for the purpose of building your website.

Deliverables

Upon full payment, you own the custom website we build for you, including the HTML, CSS, and JavaScript code, text content written for your site, and the overall design. You are free to use, modify, and distribute your website as you see fit.

Our Tools and Methods

We retain ownership of our proprietary tools, templates, processes, and methodologies used to create your website. This does not affect your ownership of the final deliverable.

Portfolio Rights

We may display your completed website in our portfolio, case studies, and marketing materials unless you notify us in writing that you do not wish to be featured.

6. Website Hosting

If you purchase hosting through us:

• Your website will be hosted on Netlify's global edge network with 99.9% uptime SLA
• Free SSL certificates (HTTPS) are included
• We manage the hosting infrastructure on your behalf
• You may request to migrate your website to a different host at any time, and we will provide the necessary files
• We are not responsible for downtime caused by Netlify's infrastructure, third-party services, or events beyond our reasonable control

7. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim arising from your use of our Services is limited to the amount you paid for the specific service giving rise to the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of business, or loss of data.
• We are not liable for the performance of your website after delivery, including search engine rankings, lead generation results, or conversion rates. While we optimize for these outcomes, we do not guarantee specific results.
• We are not liable for any issues caused by modifications you or a third party make to the website after delivery.

8. Disclaimer of Warranties

Our Services are provided "as is" and "as available." While we take pride in our work and strive for high quality, we disclaim all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Any guarantee of specific business results (leads, sales, rankings, traffic)
• Uninterrupted or error-free operation of your website

This does not affect any rights you may have under applicable consumer protection laws that cannot be waived by contract.

9. Dispute Resolution

If a dispute arises between you and us:

• Step 1: Contact us at hello@sickwebsites.com. We will attempt to resolve the dispute informally within 30 days.
• Step 2: If we cannot resolve the dispute informally, either party may pursue resolution through the courts of the State of Illinois, Will County, and you agree to the jurisdiction of those courts.

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles.

10. Indemnification

You agree to indemnify and hold harmless G! Marketing LLC, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your breach of these Terms
• Your use of the Services
• Content you provide that infringes on third-party intellectual property rights
• Any violation of applicable law in connection with your use of the website we deliver

11. Acceptable Use

You agree not to use our Services to create websites that:

• Promote illegal activities
• Contain hate speech, harassment, or discriminatory content
• Infringe on the intellectual property rights of others
• Distribute malware or engage in phishing
• Violate any applicable federal, state, or local law

We reserve the right to refuse or cancel any order that violates these guidelines.

12. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Changes apply to orders placed after the updated date. Existing orders are governed by the Terms in effect at the time of purchase.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and G! Marketing LLC regarding your use of the Site and purchase of Services. These Terms supersede any prior agreements or communications.
